These Terms govern your access to and use of our image generation technology platform artifyne.net ("Platform"), which allows users to create digital artwork and visuals (“Artwork”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Platform.

Intellectual Property Rights

It is strictly prohibited to reproduce, modify, decompile, disassemble, or reverse-engineer the Platform or its components. Unauthorized attempts to extract the source code, translate the Platform into other languages, or create derivative works are not permitted. All ownership rights, including trademarks, copyrights, database rights, and other intellectual property associated with the Platform, remain fully vested in AIScience s.r.o. Unauthorized use of any proprietary content, including automated scraping or replication of images generated by the Platform, is strictly forbidden and may result in legal action.

Platform Limitations & Disclaimers

AIScience s.r.o. does not guarantee uninterrupted or error-free functionality. Some features require an active internet connection. If you lack Wi-Fi access and have exhausted your data allowance, AIScience is not responsible for any diminished functionality. The Platform may experience downtime due to maintenance, updates, or unforeseen technical failures, and we do not accept liability for any resulting inconvenience or loss.

Acceptance of Terms

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional terms, policies, and guidelines published on our website. We reserve the right to update these Terms at any time without prior notice. Your continued use of the Platform signifies your acceptance of any modifications.

"API": Application Programming Interface provided by OpenAI (see details at https://openai.com/about)
"Company": AIScience s.r.o., a company incorporated in the Czech Republic with registered number 22106561 and address Příčná 1892/4, Nové Město, 110 00 Praha
"Platform": Our website Artifyne.net and services that provide image generation technology
"User": Any individual who accesses or uses our Platform
"User Account": A personal profile containing Personal Data created by a User
"User-Generated Content": Any content, including artwork and visuals, created or uploaded by Users on our Platform

User Eligibility

By using our Platform, you represent and warrant that you are of legal age in your country of residence to enter into these Terms. The Platform is intended for individuals at least 18 years old. If you are under 18, you must obtain consent from a parent or legal guardian before using the Platform.

Certain jurisdictions may restrict access to our Platform. Users are prohibited from accessing our Platform if they reside in or are located in the following restricted regions: Afghanistan, Cuba, Iran, North Korea, Syria, Russia, Belarus, Crimea, Donetsk, Luhansk, Myanmar, Central African Republic, China, Democratic Republic of Congo, Lebanon, Libya, Mali, Nicaragua, Somalia, Sudan, Venezuela, Yemen, and Zimbabwe. This list is subject to change based on evolving legal and regulatory requirements.

Service Description

Our Platform provides Users with AI-powered image generation technology through an API. The Platform includes features such as customizable templates, artistic effects, and digital enhancements. We reserve the right to modify, update, or discontinue any features or services at our sole discretion.

User Account Responsibilities

Your User Account is personal and non-transferable.
You are responsible for safeguarding your login credentials and all activities occurring under your account.
We may request additional identity verification documents after registration.
Failure to provide requested information may result in suspension or termination of your account.
We reserve the right to block or suspend inactive accounts after six (6) months of inactivity. Prior to such action, we may attempt to notify you using your registered contact details.

Payments & Refunds

Payment Policy

Some Platform features are available for a fee, clearly displayed on our website.
Prices are subject to change, but any modifications will not affect prior purchases.
We accept credit cards, debit cards, and other payment methods as indicated during checkout.
Users may have the option to top up their accounts for streamlined transactions.
You are responsible for any applicable taxes.

Refund Policy

You are eligible for a refund only if:

The purchased artwork is corrupted or defective.
You have not downloaded or accessed the artwork.
You request a refund within 14 days of the purchase date.

Refunds will not be provided if:

You change your mind or are dissatisfied with an artwork.
You have already downloaded or accessed the artwork.
You request a refund after 14 days.
The refund request pertains to account top-ups or deposits.

Refunds will be processed using the original payment method. Processing times may vary based on your financial institution.

Prohibited Conduct

Users may not:

Use the Platform for illegal purposes or in violation of any laws.
Attempt unauthorized access to restricted areas of the Platform.
Interfere with the functionality of the Platform, including spreading malware.
Use bots, automated scripts, or scraping tools to extract data.
Impersonate other Users or provide false information.
Send unsolicited messages (spam) or engage in fraudulent activities.
Violate intellectual property rights or share unauthorized copyrighted material.
Engage in harassment, threats, discrimination, or abusive behavior.
Engage in excessive usage that could impair Platform performance.

We reserve the right to investigate any violations and take appropriate action, including account suspension, legal action, or reporting to law enforcement.

Termination of Services

We reserve the right to suspend, terminate, or restrict your access to our Platform without prior notice if:

You violate any provisions of these Terms.
Your activity is deemed suspicious or fraudulent.
You engage in conduct that harms the Platform or other Users.
We are required to do so by legal or regulatory obligations.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be effective upon posting on our website. Continued use of the Platform constitutes acceptance of the revised Terms.

Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force. These Terms constitute the entire agreement between you and us concerning the Platform, superseding any prior agreements.
